These Terms of Use ("Terms") govern your use of practicewebstudio.com (the "Site") and the website design services provided by PracticeWeb Studio ("PracticeWeb," "we," "us," or "our"). They also govern the agreement between us and clients who purchase our Services.
By using the Site or purchasing the Services, you agree to these Terms. If you do not agree, please do not use the Site or the Services.
PracticeWeb provides a productized website design service for private practices. Our core offering ("Core Build") is a flat-fee website build delivered from our practice website templates.
We also offer related services, which may include annual domain and hosting, an optional monthly Care Plan, and add-ons such as extra pages, logo cleanup, and copywriting. The specific features and inclusions are described on the Site and may be updated from time to time for new orders.
Current pricing is published on the Site, including the flat one-time Core Build fee, annual domain and hosting, the optional Care Plan, and available add-ons. Pricing may change at any time, but changes do not affect orders already confirmed.
To reserve a build slot, you pay a deposit equal to 50% of the Core Build fee. The remaining balance is due before your website is published and made live. Domain, hosting, Care Plan, and add-on fees are billed as described on the Site or in your invoice.
All fees are stated in US dollars and are exclusive of any taxes that may apply. Payments are processed through a third-party payment processor, and you agree to its terms when you pay.
After you reserve a slot and pay your deposit, you will complete an intake form describing your practice, services, and brand. We use this information to design and build your site from our templates.
You agree to provide accurate, complete, and lawful content and information, and to respond to requests for feedback or approval in a timely manner. Delays in providing content, feedback, or approvals, or in paying amounts due, may delay your project. Timelines we share, such as a preview within two business days, are good-faith estimates that depend on your timely cooperation and are not guarantees.
The Core Build includes a reasonable round of revisions to your site before launch, as described during your project. Work that goes beyond the agreed scope, such as additional pages beyond those included, custom features, or major redesigns, may be quoted separately as add-ons.
We will let you know before carrying out work that falls outside the agreed scope.
Domain registration, hosting, and SSL are provided on an annual basis at the published rate and are renewed each year unless you tell us otherwise. If domain or hosting fees are not paid, your website may be suspended or taken offline.
The Care Plan is an optional monthly service covering small edits and ongoing maintenance such as plugin, security, and uptime monitoring. You may cancel the Care Plan at any time, effective at the end of your current billing period. Cancelling the Care Plan does not affect your ownership of your site, but it ends the included maintenance and small-edit service.
Once your Core Build is paid in full, you own the final delivered website, including your content, text, and images. You are free to keep your site, move it elsewhere, or have it maintained by another provider.
PracticeWeb retains all rights to its underlying templates, frameworks, design systems, code libraries, and any tools or processes used to build your site. Nothing in these Terms transfers ownership of those underlying assets to you. We may also feature general, non-confidential details of completed work in our portfolio and marketing unless you ask us in writing not to.
You are responsible for the content you provide, including text, images, logos, and any patient testimonials or reviews. You confirm that you own or have the right to use all content you provide and that it does not infringe the rights of others or violate any law.
You are responsible for your own legal and regulatory compliance, including any rules that apply to your profession, your practice, your advertising, and the handling of patient information. We are a website vendor and are not responsible for your compliance obligations.
Our Services deliver a marketing website with a contact form. Unless we agree otherwise in writing, our standard build is not a medical records system and is not represented as a HIPAA-compliant platform for storing or transmitting protected health information.
You are responsible for using appropriate, compliant tools for any clinical, scheduling, or records functions and for any patient information your practice handles. If your needs require a HIPAA-compliant solution or a business associate agreement, you must tell us in advance so it can be scoped and addressed separately.
We build your website to a professional standard and set it up with on-page SEO. We do not, however, guarantee any specific search engine rankings, amount of traffic, number of inquiries, patient bookings, or business results.
Search engine performance and patient response depend on many factors outside our control. Any timelines, estimates, or examples we share are illustrative and not promises of a particular outcome.
Your website and our Services rely on third-party tools and platforms, which may include content management systems, plugins, hosting providers, domain registrars, and payment processors. These are provided subject to their own terms, and we do not control and are not responsible for their availability, performance, or changes.
The Site and the Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Site or Services will be uninterrupted, error-free, or completely secure.
To the fullest extent permitted by law, PracticeWeb and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of the Site or Services.
To the fullest extent permitted by law, our total liability for any claim relating to the Site or Services will not exceed the total amount you paid to us for the Service giving rise to the claim.
You agree to indemnify and hold harmless PracticeWeb and its team from any claims, damages, losses, or expenses, including reasonable legal fees, arising from your content, your use of the Site or Services, your website after delivery, or your breach of these Terms or any applicable law.
The deposit reserves your build slot and covers initial work, and is non-refundable once work on your project has begun.
Either party may end a project if the other materially breaches these Terms and does not fix the issue within a reasonable time after notice. Fees for work already performed remain payable.
You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, scraping content, or using it for any unlawful purpose.
We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Your continued use of the Site or Services after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of [GOVERNING JURISDICTION], without regard to its conflict of laws rules. Any dispute will be subject to the courts located in [GOVERNING JURISDICTION], unless otherwise required by applicable law.
